The complainant has requested emails, photographs and notes relating to planning applications and issues around planning for a particular property. Welwyn Hatfield Borough Council (“the Council”) initially provided some information. After further prompting from the complainant, the Council identified further information within the scope of the request and disclosed this. During the course of the Commissioner’s investigation more information was located and disclosed to the complainant. The Commissioner’s decision is that the Council breached section 10(1) of the FOIA as it did not provide all information within the scope of the request within the statutory time for compliance. The Commissioner requires no steps to be taken.
