The complainant has requested information about particular BBC teams that had responded to a staff survey in 2012. The British Broadcasting Corporation (‘the BBC’) refused to disclose the information and cited the exemption under section 40(2) of the FOIA (third person personal data) as its basis for doing so. The Commissioner’s decision is that the BBC has incorrectly applied this exemption and requires the BBC to disclose to the complainant the information it withheld. The Commissioner also found that the BBC failed to respond to the request within 20 working days, breaching section 10 of the FOIA. Information Tribunal appeal EA/2014/0151 disposed of by consent.
