The complainant requested information relating to the police investigation into the Omagh bombing in 1998. The Police Service of Northern Ireland (the PSNI) provided some information but refused to confirm or deny whether it held information relevant to parts 2 and 3 of the request in reliance on sections 23(5), 24(2) and 30(3) of the FOIA. The Commissioner’s decision is that the PSNI was entitled to rely on sections 23(5) and 24(2) in relation to these parts of the request, and he does not require any steps to be taken. This decision notice is currently under appeal to the Tribunal.
