The complainant has requested to know what particular qualifications a council employee, who is now retired, had in surveying and cartography. Hampshire County Council (HCC) initially refused to provide the information relying on section 40(2) of the FOIA, but then amended its position during the Commissioner’s investigation to neither confirm nor deny holding the information under section 40(5) of the FOIA. The Commissioner’s decision is that the council has correctly relied on section 40(5) of the FOIA to neither confirm nor deny holding the information. The Commissioner does not require the council to take any steps.
