The complainant has requested a copy of the legal opinion provided by the public authority’s Counsel, which is referenced on page 9 of a document entitled, ‘Investigation into the Cornfactor Development Planning Issues’. The Commissioner’s decision is that Christchurch Borough Council is entitled to rely on Regulation 12(5)(b) of the EIR to withhold the information sought by the complainant. Information Tribunal appeal EA/2014/0272 dismissed.
