The complainant requested information about a planning decision. The Department claimed that it did not hold the requested information. The Commissioner’s decision is that the Department does not hold the requested information and was therefore entitled to rely on the exception at regulation 12(4)(a) of the EIR. However the Commissioner also finds that the Department did not respond to the request in accordance with the time for compliance under the EIR.
