The complainant has requested the sale agreement for land sold by Kent County Council to a developer in Dartford. The council disclosed some of the information but withheld some details under the exception for adverse effect to the confidentiality of commercial information (regulation 12(5)(e) of the EIR). The Commissioner’s decision is that Kent County Council has failed to demonstrate that regulation 12(5)(e) is engaged. The Commissioner requires the public authority to disclose the requested information to the complainant.
