The complainant has requested information about the criteria used by Cornwall Council with regard to its responsibilities as a Lead Local Flood Authority (“LLFA”) to investigate flooding of a property under the Flood and Water Management Act 2010 and Land Drainage Act 1991. The Commissioner’s decision is that Cornwall Council has contravened the requirements of Regulation 5(2) by failing to provide the complainant with the relevant information within the twenty day compliance period provided by the EIR. The Commissioner does not require the Council to take any further action in this matter.
