The complainant requested internal correspondence and emails relating to a particular building in Cardiff Bay – the Coal Exchange. Cardiff Council (‘the Council’) responded stating that it considered section 12 to apply as compliance with the request would exceed the appropriate limit and it also considered the request to be vexatious under section 14 of the FOIA. The Council confirmed that its position was final and it was not prepared to undertake an internal review. The Commissioner’s decision is that the Council has incorrectly applied section 14(1) of the FOIA to the request. The Commissioner requires the Council to issue a fresh response under the FOIA without relying on section 14(1) of the FOIA. Information Tribunal appeal EA/2014/0309 dismissed
