The complainant has requested the council to disclose information relating to the site visits it undertook to a particular property between July 2011 and 2014. The council responded providing the recorded information it holds. The complainant was however dissatisfied with this response and felt the council should hold further recorded information. The Commissioner’s decision is that on the balance of probabilities the council does not hold any further recorded information to that already provided. As a result he requires no further action to be taken. The Commissioner has however noted that the council breached section 10 of the FOIA in this case by failing to respond to the complainant’s request within 20 working days.
