The complainant has made two requests for information to Hampshire County Council (“the Council”): In the first request the complainant asked for information relating to complaints submitted to the Independent Police Complaints Commission about the conduct of the Police and Crime Commissioner. In her second request the complainant asked for information about the declaration of interests made by members of the Hampshire Police and Crime Panel. The Commissioner’s decision is that the Council does not hold any of the information sought by the complainant in her first request by virtue of section 3(2) of the FOIA. However by failing to advise the complainant of this fact, within twenty working days of her making this request, the Council has contravened section 10 of the FOIA. The Commissioner finds that the Council responded to the complainant’s second request within the twenty working day compliance period. He is content with the actions taken by the Council in dealing with the complainant’s request under its normal business procedures rather than under the provisions of the FOIA. The Commissioner does not require the Council to take any further action in respect of this complaint.
