The complainant submitted a request to Cornwall Council (the Council) seeking a list of unlicensed houses in multiple occupancy (HMOs). The Council initially withheld this information on the basis of sections 30, 40 and 41 of FOIA. In an earlier decision notice the Commissioner ordered the Council to disclose this information to the complainant. Having received this information the complainant contacted the Commissioner in order to complain that the Council held the details of more unlicensed HMOs than had been provided to him. Having investigated this further complaint the Commissioner has concluded that on the balance of probabilities the Council has provided the complainant with all of the information that it holds.
