The complainant has requested information regarding an allegation of a breach of planning regulations. The Commissioner’s decision is that because the information is environmental, the request should have been dealt with under the EIR. He has also decided that North East Derbyshire District Council correctly applied the exception for personal data at Regulation 13 of the EIR to the name of the person making the allegation and that no further information within the scope of the request is held. The Commissioner does not require the public authority to take any steps to ensure compliance with the legislation.
