The complainant has requested from the London Borough of Tower Hamlets (“the Council”) information relating to the statement of persons nominated in 2010. After investigation, the Information Commissioner has found that the information sought by the complainant is not held by the Council for the purposes of FOIA. The Commissioner’s decision is that the Council is entitled to rely on section 3(2)(a) of the FOIA. However the Council has breached section 10 of FOIA as it failed to provide a substantive response within twenty working days. The Commissioner requires the public authority to take no steps.
