The complainant requested information about a named individual’s employment. Carmarthenshire County Council (‘the Council’) stated that the information requested was exempt under section 40(2) of the FOIA. During the course of the Commissioner’s investigation, the Council confirmed that it did not hold some of the information requested and maintained that other information held was exempt under section 40(2) of the FOIA. The Commissioner’s decision is that the Council correctly applied section 40(2) to the information it holds relevant to the request. The Commissioner does not require any steps to be taken.
