The complainant has requested from London Borough of Bexley (the “Council”) copies of correspondence between the Council’s legal department and Bexleyheath Police regarding an incident at Bexley civic centre. The Council refused to comply with the request for information as it deemed the request to be vexatious in accordance with section 14 of the FOIA. The Commissioner’s decision is that the request is vexatious and that the Council had correctly applied section 14 of the FOIA to refuse the requested information. However, the Council failed to provide a response to the request within the statutory timeframe of 20 working days and breached the requirement of section 10(1) of the FOIA. The Commissioner does not require the Council to take any steps.
