The complainant requested copies of the minutes of the Staffing Panel Meetings between August 2005 and August 2006. The Commissioner’s decision is that Aberystwyth Town Council (‘the Council’) has breached sections 1 and 10 of the FOIA as it has failed to confirm or deny whether information is held within 20 working days of receipt of the complainant’s request. The Commissioner requires the Council to provide the complainant with a response to her request which complies with the requirements of section 1(1) of the FOIA, or issue a valid refusal notice.
