The complainant requested from the London Borough of Brent (“the Council”) information regarding its handling of requests under the Freedom of Information Act 2000 (“FOIA”). The Council applied section 12 to the request on the basis that it had estimated that responding to the request would exceed the appropriate limit under the Act. The Commissioner’s decision is that the Council has correctly applied section 12 of FOIA but that it has breached section 10 by not providing a response to the request within 20 working days.
