The complainant has requested information on the cost to the Council of claims made against it in respect of equal pay. The Commissioner’s decision is that the Council has failed to respond to the request within the statutory time for compliance. This is a breach of section 10 of FOIA. The Commissioner requires the public authority to either comply with section 1 by confirming whether it holds the information and, if so, communicate that information to the complainant, or issue a refusal notice in compliance with section 17 explaining its basis for refusing to provide the information.
