The complainant requested the letters of complaint and the Officer’s report from two visits. Waverley Borough Council (the Council) provided some information, confirmed that some was not held and that the complaints letters were withheld under section 41 (information provided in confidence). The complainant considered that further information must be held by the Council. The Commissioner’s decision is that the Council has correctly applied section 41(a) to the withheld information. The Commissioner’s decision is that the Council does not hold any further information within the scope of the request. The Commissioner has not investigated section 14 (vexatious complaints) as it was not cited by the Council. The Commissioner does not require the public authority to take any steps as a result of this decision notice. Information Tribunal appeal EA/2015/0012 dismissed.
