The complainant has requested a copy of all documents sent by the Information Commissioner’s Officer (“ICO”) to Lancashire Police (“the Police”) regarding his complaint and all documents sent by the Police to the ICO, including staff names. The ICO confirmed that information was held and disclosed the information but with some redactions made on the basis of section 40(2) and 44(1)(a) of the FOIA.
The Commissioner’s decision is that the ICO has correctly applied section 40 and section 44 by virtue of section 59 of the Data Protection Act 1998, as amended by the FOIA, to withhold this information.
