The complainant has requested a copy of all documents regarding a groundwater pollution incident that occurred in 1997. The Environment Agency (EA) refused to disclose the information citing Regulation 13(1) of the EIR arguing that the information constituted the personal data of a sole trader and its disclosure would breach the first principle of the Data Protection Act 1998 (DPA). The Commissioner’s decision is that the Environment Agency has correctly applied regulation 13(1).The Commissioner does not require the public authority to take any steps. Information Tribunal appeal EA/2015/0049 part allowed.
