The complainant has made a request to Blackpool Borough Council (“the council”) for information relating to a project funded by the European Regional Development Fund (“the ERDF”). The council refused the request under the exclusion provided by section 14(1) of the Freedom of Information Act (“the FOIA”). The Commissioner’s decision is that the council has correctly refused the request under section 14(1). However, in failing to provide a refusal notice within the time for compliance, the council breached section 17(5). The Commissioner does not require any steps to be taken. Information Tribunal appeal EA/2015/0182 dismissed.
