The Commissioner’s decision is that; the public authority does not hold information within the scope of the complainant’s request in relation to Alexander Joseph Patrick Wilson (Part a of the request). The public authority was entitled to withhold the material retained from file FO 1093/263 in reliance on the exemption at section 23(1) FOIA (Part b of the request). The public authority breached section 10(1) FOIA. No steps required. Information Tribunal appeal EA/2015/0224 dismissed.
