The complainant requested information related to a clinical trial concerning treatments for chronic fatigue syndrome (“CFS”) carried out by Queen Mary University of London (“the University”). The University withheld the information under the exemptions in sections 22A, 40(2), 41 and 43(2) of FOIA. The Commissioner’s decision is that the University has incorrectly applied sections 22A, 40(2), 41 and 43(2) of FOIA to the withheld information. The Commissioner requires the public authority to disclose to the complainant the information to which it has applied sections 22A, 40(2), 41 and 43(2) of FOIA. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
