The complainant requested information relating to the misconduct figures published by the College of Policing (the College). The College refused the request, citing section 40(2) (personal information) of FOIA. The Commissioner’s decision is that the College has incorrectly applied the exemption for personal data at section 40(2) of the FOIA as the withheld information is sufficiently anonymised to take it out of the definition of personal data. The Commissioner requires the College to disclose the withheld information. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
