The complainant made a freedom of information request to the Trust which asked for, amongst other things, copies of two reports prepared by Deloitte following recommendations made by the review undertaken by Sir Bruce Keogh into the Trust. The Trust has refused the request by relying on the section 41 (information provided in confidence) exemption. The Commissioner has investigated the complaint and found that the section 41 exemption is not engaged. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation. The Trust shall disclose the withheld information to the complainant.
