Cornwall Council

The complainant has made a request to Cornwall Council (“the council”) for information about a planning application. The council treated the request as being an appeal for an internal review on a prior request by the complainant, and as such did not action it as a new request. The Commissioner’s decision is that the council failed to provide a valid response to the complainant’s new request, and has breached the requirement of regulation 5(1) of the Environmental Information Regulations (“the EIR”). The Commissioner requires the public authority issue a response to the complainant’s new request of 21 April 2015.
