The complainant requested all documents from the Charity Commission’s case reference c-350240 (or c-350240-FPDB) regarding the split of Global Warming Policy Foundation (GWPF) into charitable and campaigning arms. The Charity Commission refused to comply with the request citing section 14 FOIA. The Commissioner’s decision is that the Charity Commission has incorrectly applied section 14 FOIA to the request. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation. The Charity Commission should now issue a fresh response to the request without relying on section 14(1).
