The complainant has requested from Tempus Leisure the total costs of signs put up on leisure centres in Cornwall. Tempus Leisure informed the complainant that the signage has been financed by its annual marketing budget but did not provide the actual cost. It explained to the Commissioner that it is not a public authority for the purposes of the FOIA and therefore is it not compelled to release information requested under the FOIA. The Commissioner’s decision is that Tempus Leisure is not a public authority for the purposes of the FOIA. He therefore requires no steps to be taken in this case. This decision notice is currently under appeal to the Tribunal.
