The complainant has requested correspondence between Plymouth City Council (‘PCC’) and both The Events Services Association (‘TESA’ ) and the British Pyrotechnists Association (‘BPA’). Having initially found that compliance with the request would exceed the cost limit at section 12 of the FOIA, PCC found that a refined request was vexatious under section 14(1) of the FOIA. The Commissioner’s decision is that the request is vexatious and that the PCC was correct to rely on the exclusion at section 14(1) of the FOIA. No steps are required. Information Tribunal appeal EA/2016/0028 allowed.
