The complainant has requested any information held by the Metropolitan Police Service (the “MPS”) about the arrest, trial and imprisonment of Hemant Lakhani who died in prison in 2013. The MPS refused to confirm or deny that it held the requested information citing sections 23(5) (supplied by, or relating to, bodies dealing with security matters), 24(2) (national security), 27(4) (international relations), 30(3) (investigations and proceedings), 31(3) (law enforcement) and 40(5) (personal data) of the FOIA. The Commissioner’s decision is that the MPS was entitled to rely on sections 23(5) and 24(2). No steps are required.
