The complainant has requested the bid submitted by a particular company as part of a procurement exercise for the provision of health care in adult male prisons. NHS England refused to provide the tender submission under section 43 – commercial interests. The Commissioner’s decision is that NHS England is entitled to withhold the majority of the information under section 43. However some of the information is not exempt and should be disclosed subject to minor redactions which are necessary to remove the personal data of the successful bidder’s staff. The information to be disclosed has been identified to NHS England in a confidential annex to this notice. The Commissioner requires the public authority to now disclose the information identified in the confidential annex.
