The complainant asked whether a birth certificate was submitted by a named individual to the Government Legal Department (GLD). The GLD refused the request under section 41(2) of the Freedom of Information Act 2000 (the Act) as to confirm or deny whether the information was held would be an actionable breach of confidence.  The Commissioner’s decision is that the GLD is entitled to refuse the request under section 41(2). No steps are required.
