The complainant requested information relating to computer virus issues recorded by the IT department at Grimsby Magistrates court within a specified timeframe. The Ministry of Justice (MoJ) ultimately neither confirmed nor denied holding the requested information citing section 31(3) (law enforcement) of the FOIA. The Commissioner’s decision is that the MoJ was entitled to rely on section 31(3) FOIA as the basis for not complying with the duty to confirm or deny whether it held the requested information. The Commissioner requires no steps to be taken as a result of this decision. Information Tribunal appeal EA/2016/0303 dismissed.
