The Commissioner’s decision is that Hertsmere Borough Council has correctly applied the exemption for third party personal data at section 40(2) of the FOIA and, insofar as the information is environmental, regulation 13(1) of the EIR. The Commissioner does not require the public authority to take any steps to ensure compliance with the legislation.
