The complainant submitted a request to the public authority for a copy of a viability assessment report and an independent appraisal pursuant to a planning application for Wimbledon Greyhound Stadium. The requested information was withheld by the public authority in reliance on the exceptions at regulations 12(4)(d) (material in the course of completion) and 12(5)(e) (confidentiality of commercial information) of the EIR. The Commissioner concluded that the public authority was entitled to rely on the exception at regulation 12(5)(e). She however found the public authority in breach of the procedural requirement in regulation 14(2) of the EIR.
