Stratford-on-Avon District Council

The complainant has requested information from Stratford-on-Avon District Council (“the Council”) regarding the views of two independent persons which had been submitted to the Council in relation to its decision whether or not to investigate a complaint about a named councillor. The Council withheld the information under section 36(2) of the FOIA: Disclosure prejudicial to the effective conduct of public affairs. The Commissioner’s decision is that the Council has correctly applied section 36(2)(b)(i) and section 36(2)(c) to the withheld information. The Commissioner does not require the public authority to take any steps. Information Tribunal appeal EA/2017/0220 no right of appeal.
