NHS Norwich Clinical Commissioning Group

The complainant has requested from Norwich Clinical Commissioning Group (‘the CCG’) a functioning version of a particular spreadsheet. The CCG has withheld the information under section 43(1) of the FOIA (trade secrets) and 43(2) (prejudice to commercial interests). The Commissioner’s decision is that: the CCG can be said to hold the requested information in line with section 1(1)(a) of the FOIA; and that the requested information is exempt from disclosure under section 43(2), with the public interest favouring maintaining the exemption. The Commissioner does not require the public authority to take any steps to ensure compliance with the legislation. This decision notice is currently under appeal to the Tribunal.
