The complainant has requested information on a complete and up-to-date list of all business (non-residential) property rates data held by the council. The council disclosed the majority of the information but applied section 31(1)(a) to information on whether properties were occupied or not. It argued that disclosing this information would prejudice the prevention and detection of crime as it would provide details which would facilitate criminal activity. The Commissioner’s decision is that the council was not correct to apply Regulation 31(1)(a) to the information.
