The complainant has requested information about DEFRA’s awareness of the requirements in other EU member states regarding the trade in captive-bred, wild birds. The Commissioner has determined that DEFRA does not hold any information relevant to parts (1) and (2) of the request as numbered in this notice. However, the Commissioner’s decision is that DEFRA has incorrectly applied the exemption at section 21 of the FOIA to part (3) of this request. The Commissioner requires DEFRA to issue a fresh response to the complainant with regard to part (3) which does not rely on section 21. Information Tribunal appeal EA/2018/0092 dismissed.
