The department neither confirmed nor denied whether it held information within scope of the request, relying on the exclusions at sections 24(2) and 31(3) FOIA. The Commissioner has concluded that the Treasury was not entitled to neither confirm nor deny whether it held information within scope of the first part of the request, but was entitled to neither confirm nor deny whether it held information within the scope of the second part of the request.
