The complainant has requested information on the decision to relocate adult day care services from a particular centre and the assessments it had carried out in respect of the alternative venues to be used for providing that care. The council initially said that it did not hold the requested information. However during the course of the investigation the council reconsidered its interpretation of the request and ultimately provided information which the Commissioner considers does fall within its scope. The Commissioner’s decision is that by not providing this information within twenty working days the council has breached section 10 of the Act. However as the council has no provided the information the Commissioner does not require the public authority to take any further action in this matter.
