  • Decision(s) FOI 40: Upheld, FOI 43: Partly upheld

The complainant has requested the technical reports on the aptitude tests UKCAT provides and which are used by various medical schools as part of their admissions process. UKCAT withheld the information under section 43(2), prejudice to commercial interests. The Commissioner’s decision is that UKCAT is entitled to withhold some of the information from the reports. This is primarily that information analysing how well the actual test questions (referred to as ‘items’) performed. However, the Commissioner finds that some of the more general information and the analyses of how examinees performed is not exempt and should be disclosed. Although not cited by the public authority the Commissioner also finds that some of the personal data contained in the reports can be withheld under section 40(2). The Commissioner requires the public authority to disclose the information identified in the confidential annex that accompanies this notice and which will be provided exclusively to the public authority. Information Tribunal appeal EA/2018/0110 and EA/2018/0100 withdrawn.
