West Midlands Police refused to either confirm or deny holding information within the scope of the request, citing section 40(5) (personal information) of the FOIA. The Commissioner’s decision is that West Midlands Police was correct to neither confirm nor deny holding information within the scope of the request by virtue of section 40(5)(a) of the FOIA. The Commissioner requires no steps to be taken as a result of this decision.
