The complainant requested from Middlesbrough Council information consisting of emails sent to and from a specific Council officer in relation to Middlesbrough Bus Station. The Council disclosed some information and decided to withhold the remainder. The complainant, however, is unhappy that the Council did not provide the information within the time period stipulated in Regulation 5(2) of the

EIR (20 working days).

The Commissioner’s decision is that the Council failed to respond to the complainant’s request within 20 working days and has therefore breached Regulation 5(2) of the EIR. 

Since the request has now been responded to, the Commissioner does not require the Council to take any further step in relation to this complaint.
