The complainant has requested information from St Brendan’s Primary School (“the School”) regarding correspondence from the School’s Board of Governors. The School stated that it does not hold any recorded information within the scope of the complainant’s request other than that which the complainant has already received. The Commissioner’s decision is that the School has breached Section 1(1) of the FOIA by not disclosing some of the information it holds in response to the complainant’s request. The Commissioner requires the School to take the following steps to ensure compliance with the legislation:-
- Issue a fresh response to the complainant providing him with the information it does hold. The School must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
