The complainant has requested information from the DVA relating to Approved Driving Instructors having been removed from the register of Approved Driving Instructors for criminal convictions.  The DVA disclosed some of the requested information to the complainant, however it refused to disclose the remainder, citing section 40(2) of the FOIA as a basis for non-disclosure.  The Commissioner’s decision is that the DVA has correctly applied the above exemption to the information not disclosed to the complainant.  Therefore, the Commissioner requires no steps to be taken.
