The DWP relies on sections 24(2) and 31(3) of the FOIA to neither confirm nor deny that it holds the requested information. The Commissioner’s decision is that DWP incorrectly applied sections 24(2) and 31(3). The DWP is required to confirm or deny whether the requested information is held and either disclose it or issue a fresh response compliant with section 17 of the FOIA.
