The complainant requested from Middlesbrough Council information in relation to a pre-planning application meeting between the Council’s planning department and Cambian PLC. The Council stated that it held no information within the scope of the request because such a meeting did not take place.
The Commissioner’s decision is that, on the balance of probabilities, the Council does not hold information within the scope of the request in this case. However, by responding to the request outside of the 20 working day timeframe, the Council breached regulation 5(2) of the EIR.The Commissioner does not require the Council to take any steps.
